Redondo Peninsula Energy Inc. said Friday it can still proceed with the construction of its 600-megawatt coal-fired power plant at the Subic Bay Freeport even with the issuance of a Writ of Kalikasan by the Supreme Court.
RP Energy said the Supreme Court resolution dated July 31 did not act on the petition to issue a temporary environmental protection order against the $1.28-billion coal power project.
“Based on the unofficial copy of the SC resolution, the high court did not issue a TEPO to stop RP Energy’s activities,” RP Energy said.
RP Energy is a joint venture among Meralco PowerGen Corp., a unit of Manila Electric Co., and Therma Power Inc. of the Aboitiz Group and Taiwan Cogeneration International Corp. Meralco PowerGen owns a 50 percent plus two shares in the joint venture while Therma Power and Tawian Cogeneration hold the balance.
RP Energy said it would proceed with with preparations for the construction of the power plant until the TEPO is issued. The TEPO is part of the rules of procedure for environmental cases.
The TEPO will prohibit or put a stop to the construction of the project while the case is pending with the court.    source
