OPEN ACCESS should now be declared by the Energy Regulatory Commission (ERC) as preconditions set by law have apparently been met, legislators yesterday said.
Under the 2001 Electric Power Industry Reform Act (EPIRA), open access -- which will allow those consuming more than 100 kilowatt-hours per day to choose where to source their power -- can be declared once 70% of state-owned generating assets and 70% of independent power producer administrator (IPPA) contracts are privitized.
Presentations made by the ERC and the Power Sector Assets and Liabilities Management Corp. to the Joint Congressional Power Commission (JCPC) stated that 79.56% of the generating assets and 76% of IPPAs have been successfully auctioned off.
"As long as the conditions have indeed been met, we would recommend the declaration of open access especially with the anniversary of the EPIRA coming up," Sen. Sergio R. Osmena III said during a JCPC hearing yesterday.
The ERC, however, said it still needed to evaluate comments from the public regarding open access.
"There have been submissions of positions which we are currently evaluating. We hope that we can declare by this year, maybe the middle of the year," ERC Executive Director Francis Saturnino C. Juan said in an interview after the hearing.
